Background Information

15 claims approved by Salt Lake County (pdf, 1.2 MB):  A letter submitted on September 11, 2000 by the Salt Lake County Commission at the recommendation of Neil Stack, Director of the Engineering Division for Salt Lake County. The letter lists 15 claims to be forwarded to the State for Quiet Title Action.

Mayor Workman withdraws 8 claims (pdf, 232 kB):  A letter submitted by Mayor Nancy Workman, to the Utah State Attorney General's Office on December 16, 2003. The letter requests that the 8 additional claims be withdrawn from consideration as candidates for R.S. 2477 claim status.

The Revised Statute (R.S.) 2477 Rights-of-Way Act (pdf 433 kB): A draft bill proposed by Bruce Babitt, Secretary of the Interior, that would have established a standard by which the validity of R.S. 2477 claims could be determined. The bill, submitted on August 27, 1997 was the collaborative effort of several Interior Agencies and the Departments of Agriculture and Defense.

Forest Service Memo (pdf, 439 kB):  A letter from the Deputy Chief of the National Forest Service sent on September 25, 1997 to the Regional Foresters and the OGC attorneys. The letter mentions their involvement in the development of the "R.S. 2477 Rights-of-Way Act" and asks that the processing of any R.S. 2477 assertions be delayed unless "there is a demonstrated, compelling and immediate need to make such determinations.

10th Circuit Court Decision (pdf, 369 kB):  The most recent opinion, by Judge Tina Campbell of the 10th Circuit Court, that sets 10 years of consectutive use as the standard to be met when determining whether or not a road was constructed.

The Firs, Inc.: Some Recollections of the First Seventy Years... (pdf, 10.9 MB):  A collection of stories recounted by the homeowners in Alexander Fork.

Special Use Permit (pdf 533 kB): For the purpose of a road and water system for The Firs residences.  Permit was granted by the US Forest Service to The Firs, Inc., on January 18, 1949.

Killyon’s Subdivision (pdf 94 kB):  Plat map showing Block II of the Killyon Subdivision.  This section of the subdivision extends along the first portion of Burr's Fork.  The subdivision was dedicated on August 30, 1909.

Groves Subdivision (pdf 421 kB):  Plat map showing the Groves Subdivision in Pinecrest.  This subdivision was dedicated on December 28, 1910.

Emigration Canyon

Little Mountain Subdivision No. 1 (pdf 195 kB):  Plat map of the subdivision located between the Emigration Canyon claim and the fork in the road to Burr's Fork and Killyon's Canyon.  The subdivision was dedicated on May 25, 1910.

Little Mountain Subdivision No. 2 (pdf 146 kB):  Plat map of the subdivision just up canyon from Little Mountain Subdivision No. 1.  Subdivision No. 2 was actually dedicated before Little Mountain Subdivision No. 1, on January 10, 1910.

Special Use Permit for the construction of a road (pdf 729 kB):  A copy of the special use permit granted by the U.S. Forest Service to the Utah State Road Commission.  The permit allows for the construction of the stretch of the Emigration Canyon Road that crosses Forest Service land on Little Mountain.  The permit was granted on July 30, 1938.

Transfer of the Right-of-Way for SR 65 to Salt Lake County (pdf 136 kB):  A letter from the District Director of the Utah Department of Transportation to a private homeowner in Emigration Canyon.  The letter sates that “jurisdiction of the road was transferred to Salt Lake County by State Road Commission action in December of 1965.”

State of Utah State Road Commission (pdf 1.1 MB):  Plans for the proposed state road 65, which connected Salt Lake City to Parley’s Canyon, by way of Emigration Canyon.  The plans show the new route for the road over Little Mountain, as well as the right-of-way for the road.

Mountain Top Park Subdivision (pdf 131 kB):  Plat map of the Mountain Top Park Subdivision, dedicated on October 9, 1908.  This subdivision contains approximately 150 plots, none of which are developed at this point.

Forest Home Subdivision Plat A (pdf 256 kB):  Plat map of the Forest Home Subdivision in upper Lambs Canyon.  This subdivision was dedicated on December 20, 1945.

Lost Acres Subdivision (pdf 137 kB):  Plat map of the Lost Acres Subdivision, located approximately 3 miles from the mouth of Lambs Canyon.  The subdivision was dedicated January 28, 1958.

Forest Development Road Cooperative Agreement (pdf 1.1 MB):  Lays out the general responsibilities of each party in the agreement (the US Forest Service and Salt Lake County).  The agreement is dated November 24, 1976.

Project Agreement No. 1 (pdf 214 kB):  Agreement for the maintenance of Lambs Canyon Road, by Salt Lake County, under the Forest Development Road Cooperative Agreement.  This agreement was entered into on November 24, 1976.

Little Mountain

Easement for an oil pipeline on Little Mountain (pdf 1.4 MB):  A special use permit from the U.S. Forest Service granted to Chevron for the construction of an oil pipeline on Little Mountain.  This easement was granted in May, 1948.

Millcreek Canyon

Dedication of Millcreek Canyon Road (pdf 852 kB):  This document, recorded in 1936,  shows the dedication of Millcreek Canyon Road as it crosses land owned by the Boy Scouts of America.  This dedication gives Salt Lake County the right-of-way for the road across this stretch of land.

Public Road Easement for Millcreek Canyon (pdf 172 kB):  An easement granted to Salt Lake County by the U.S. Forest Service on March 25, 1991.  This easement gives the County the right-of-way all portions of the Millcreek Canyon Road that occur on Forest Service lands.

Mill D North Fork

Special Use Permit (Road) (pdf 871 kB):  A special use permit granted to the Mill D Summer Home Association by the U.S. Forest Service on March 16, 1968.  This permit was issued "for the purpose of constructing, reconstructing, maintaining, and using" the road in Mill D North Fork.

History of the Mill D Summer Home Association (352 kB):  This document contains a "Brief History of Mill "D" North Fork from its inception in 1946 to 1976."  This historical account was compiled by Bill Vigos.

Porter Fork

Note regarding the road in Porter Fork (pdf 68 kB): A note included with information received from a Freedom of Information Act request submitted to the US Forest Service.  Author and date of note are unknown.

Rose Canyon

Right-of-way (ROW) reservation (pdf 560 kB):  The BLM reserves the ROW for a portion of the Rose Canyon Road that crosses private land.  The reservation was made on April 24, 1995.

Land patent for private land within Rose Canyon (pdf 659 kB):  A land patent granted pursuant to the Camp W.G. Williams Land Exchange Act.  This patent was granted on June 21, 1995 and includes almost 680 acres in Rose Canyon.
